Advisers can keep their "conflicted" commissions, but it's time to stop harming clients by depleting their retirement savings, says the chairman of the Labor Department's hearings on its proposed fiduciary rule. "We are absolutely not banning commissions," he says, a day after the hearings concluded. "We just want everyone who is working on retirement accounts to be acting as fiduciaries." Fiduciaries are legally bound to put their clients' best interests before their own when providing financial advice.

LA owes you money—overcharged for water, really?
The Los Angeles Department of Water and Power would credit or refund tens of millions of dollars to customers who were overbilled during the botched rollout of a new billing system. Not even fired supervisor.

Springstone caught! NO jail time
Springstone Financial was ordered to provide $700,000 in relief to victims of deceptive credit enrollment tactics. Many consumers who signed up for Springstone’s deferred-interest loan product at dental offices to pay for dental work were led to believe that the product was interest free. In fact, interest accrued from the date of the consumer’s purchase and was charged if the balance was not paid in full before the promotional period ended. Approximately 3,200 consumers who signed up for the product ultimately were charged and paid deferred interest.

State Farm sued for using “junkyard” parts to fix cars—no jail charge.
State Farm steered their customers to the company's preferred repair shops, which sometimes use "junkyard," "knock-off" or "after-market" parts instead of those provided by the manufacturer. The result can compromise safety, as well as aesthetics.

Medicare offering our data to private firms—without charge?
The Centers for Medicare and Medicaid Services will make its data available to the private sector for the first time, the agency’s acting administrator announced Tuesday. CMS noted that the data would not permit identification of patients, but would provide the identity of providers of care. “Two million people account for half of costs of the Medicare program. Often basic barriers – housing, nutrition, transportation, child care – combine” to impact health. CMS said the health care system needs “better support information, better insight …. to enable this change.” Firms can make a killing on data.

Allstate’s Tom Wilson said improved technology will eventually give the auto insurer a chance to boost revenue by selling customer driving data. Insurers are increasingly using data on customer habits to help analyze risks and set prices. The records could also be valuable to advertisers who want to know where potential customers travel and what hours they’re on the road.


Patient investors are more successful than active ones
After analyzing portfolios held by 325,000 users, the robo-adviser SigFig found that the most successful investors were the least active. Trading hurts us. Women make better investors than men. Even GOP must face facts sometimes. States have to pay bills and can’t print money so they must take personal responsibility (GOP theme). Cutting taxes in KS did not work. Businesses need good schools, roads, living wage, etc to be effective, despite what some GOP say. States do not have luxury of ideological standoff like Washington and can’t wait for the 2016 new regime.

GOP Santorum wants flat tax and no regulations—careful what you wish for
Flat tax means most Americans will pay more and wealthy pay less! American workers actually pay about 18% of income with various deductions. Wealthy pay under 20% now. But we also pay SS, Medicare, DI, UC, FL, etc etc for total of 32.9%. Buffett pays 17.7%, Kerry and Romney pay 14%. Santorum’s plan is 10% or 28% but rich will pay capital gains rate of 12% down from 20%. He cuts corporate rate to 17.5% and manufacturers pay 0%. For most working Americans who already pay 10% or less, the other taxes would have to rise since the wealthy, who have no EARNED income, would pay 12% on their assets. Corporations that pay 0% now would keep profits overseas.
Santorum will cut regs on air, food, water, smoke, etc so pollution would grow!

People are getting ready to take a stand against the Army with handguns. Media star Alex Jones is citing a plot by the Obama administration to declare martial law in Texas and take everyone’s guns. (The POLICE derailed a bill to allow people to openly carry handguns everywhere.)

Regulators fine FL mortgage foreclosure firm
Hoffman Law Group is accused of using deceptive marketing practices and scamming distressed homeowners into paying illegal advance fees. Hoffman (formerly Residential Litigation Group), its operators, Michael Harper, Benn Willcox, and attorney Marc Hoffman, Nationwide Management Solutions, Legal Intake Solutions, File Intake Solutions, and BM Marketing Group, North Palm Beach, FL promised to save 2,000 homes from foreclosure.
None will go to jail and can move operations to another state.

Your taxes go to Chevron which gave $3.5 million to Boehner’s PAC
Chevron paid $3.5 million to Big Oil's preferred congressional candidates including Leader Boehner’s Congressional Leadership Fund. But Federal law prohibits government suppliers from making campaign contributions. Now the Federal Election Commission refused to enforce the law against Chevron. Chevron says the Chevron that accepts government money and the Chevron that engages in election spending are two different Chevrons. Chevron uses over 1,000 subsidiaries to provide $15 million to politicians. Foreign dictators can donate to PACs via subsidiaries too. Former GOP leader Cantor deleted requirements from the Stop Trading on Congressional Knowledge Act in 2012 so now they can use insider info legally. Stop giving them refunds.

Buffett has a 10-year running bet with the hedge fund managers at Protégé Partners about whether hedge funds can beat a low-cost S&P index fund, and the bet is now in its eighth year. Cumulatively the S&P 500 was up more than 63 percent, while the hedge funds gained only 19.6 percent.

We’ll become Greece.” This scare tactic won’t work since Americans know Congress gives benefits to corporations and rich that give them money. It is BS to say Americans will need to pay more taxes while more corporations and wealthy pay less. We already pay 30% of income on average while they pay 15% or less.  GOP needs to read “We the people …” again.

Christie creds in the toilet
In 2011, Christie promised to pay billions of dollars into the state's woefully underfunded pension system, while public sector unions agreed to cuts in benefits. "This is what catapulted him to the national arena. Now [that he reneged,] it's really hard to reclaim that mantle." Unions gave; but Christie did NOT. Spent $1 m for PR report about himself. Gave EXXON a $9 billion gift. Blames his secretary for Bridge scandal.

GOP Supremes agreed to review Obama regs to encourage efficiency in the electricity market. Really, against efficiency or just for coal? Separately, Supremes ruled against a homeowner’s bankruptcy plan to pay even though Uncle Sam and Bank of America backed the homeowner.

Where are you putting your RMD?
Every person over age 70 has to start liquidating their IRA, 401k, 403b and most tax-deferred accounts. If you are still working and contributing to your plan, you can wait until you retire to start your RMD. You have no choice but to pay the tax you owe on your RMDs as your account is still growing. You can’t avoid tax by rolling over an RMD into another account. However to avoid future tax on future gains when you don’t need the money, you can deposit it—less the tax—into a tax-FREE Roth IRA. Agents are pushing “Secret Presidents/Congress” accounts
It is just life insurance with big commissions. Yes, you can put a lot of cash in a life insurance plan set up to a build large cash legacy. You are told it is tax-FREE to heirs and you can earn 5% on your money. This is how wealthy people can leave money to heirs. They must be put into a trust to avoid estate tax. These policies may violate IRS definition of life insurance if they put in too much. It then becomes a MEC which is taxed like an annuity. The expenses are high but are smaller than the tax bill could be. For most people, this is NOT the best alternative. The IRS allows us to leave assets to heirs tax-FREE to the heirs on a “stepped-up” basis. Heirs pay no tax on these assets until the asset accumulates its own gains for the new owner. 

Brokers sell without disclosing all fees and risks—Fiduciary rule breaking
LPL Financial Holdings Inc must pay $11.7 million for "widespread supervisory failures," including sales of a risky type of exchange traded fund and other complex securities. Brokers sell variable annuities without disclosing surrender fees, charges, etc.

The taxes you just paid financed Boeing’s most profitable business
Boeing’s $2.72 billion revenue was made possible because our taxes were used to finance sales to wealthy desert dictators. We pay for the “The Bank of Boeing,” as it is called by those who think this “bastion of corporate welfare” must be shut down. Boeing pays about $2.7 million to our “representatives” to keep this “welfare queen” in business. Right-wing power groups ousted Eric Cantor in part for supporting this big business subsidy. Like the oil, gas and farm subsidies, the Ex-Im bank was set up to spur prosperity last century. In this new age, politicians are learning that many groups don’t like giving their tax dollars for corporate tax-FREE profits.

Your pension fund is still falling behind despite market surge
The funded status of the 100 largest corporate pensions dropped by $6 billion in March, increasing the deficit to $349 billion, according to the Milliman 100 Pension Funding Index. The stock market hit new highs recently yet pension funding is going south. Many employers unaware of their retirement plan liability
Thirty-seven percent of plan sponsors are unaware they are fiduciaries to their workplace-sponsored retirement plans, according to research by AllianceBernstein, but 82% of those surveyed said fiduciary matters are important or very important to them. Employers that include target-date funds in their retirement plans are more likely to be aware of their fiduciary role. Nearly half of plan sponsors don’t take advantage of the safe-harbor protections that come with offering a qualified default investment alternative. Employers must provide options that are best for us not them—low-cost well diversified funds. Low-earning money funds are NOT safe options for retirement. Retirement account balances reached a record high $91,800 in the first quarter of 2015, and more than 1 million people increased their contributions. 

Investors moving away from broken Wall Street system—DIY winning
Affluent Americans are now not only diversifying their portfolios, they are also diversifying their brokers, with one-in-three households with greater than $100,000 in investable assets adding a new financial services firm relationship in 2014. The study, "Market Measures: Reach, Share & Other 'Store' Success Measures," surprised researchers when it showed that self-service brokerage firms are popular with the affluent set, reaching 70 percent of households with at least $500,000 in investable assets, compared with just over 40 percent for full-service firms. “It’s astonishing the self-service competitive set has deeper reach into investors with $500,000-plus, engaging more affluent investors than the full-service competitive set.

Bernie Sanders, Senator, left-leaning and has no chance! Bernie has no money. He has a voting record that most working Americans would agree with but most politicians don’t. He favors a 30% tax rate on millionaires. Crazy! He did get Congress to clean up the VA. Bernie makes Hillary look centrist and gives her someone to talk to during the primary debates. He just introduced a bill to stop corporations from sheltering income overseas in the Cayman Islands and other tax havens to avoid paying U.S. taxes. The legislation also would end tax breaks for companies that ship jobs and factories overseas.
“At a time when we have a $18.2 trillion national debt and an unsustainable federal deficit; at a time when many of the largest corporations in America are paying no federal income taxes; and at a time when corporate profits are at an all-time high, it is past time for corporate America to pay their fair share in taxes so that we can create the millions of jobs this country needs,” Sanders said at a Capitol news conference.
Bernie, you know this bill will never pass the “millionaire Congress.”

GOP backers want war?
All of the GOP candidates want to scrub the peace talks—some want war with Iran—and so do their backers. Some are meeting with deep pockets like Sheldon Adelson, who dropped over $92 million for the 2012 circus, and whose hawkish protection views are echoed by party members. Is it possible that our next military venture will be the reward for certain campaign contributions? Could we waste another $3 Trillion because of a new fake-WMD-type scare from the ideological right? President Cheney did it once.

GOP runner Christie hates pot but state needs revenue
Atlantic City gambling has been replaced by online gambling to raise taxes. However, Christie could use the extra pot taxes to replace the $9 billion he gave back to EXXON. Poor management and Wall Street tricks won’t fix the state’s pension shortfall. Property taxes are the highest in the nation. Even the low gas tax should be revised. Christie could sell his helicopter and stop traveling to raise money for the GOP. His sidekick, Weinstein has made a deal so now we may find out about Christie’s BridgeGate.

ObamaCare plans may help more patients get better care
Health insurance plans purchased through public health care exchanges often generate levels of member satisfaction higher than plans obtained through employers, according to a J.D. Power study. One main reason people shopping through the marketplaces are more satisfied is the choice and clear features of plans available. That compares with an employer plan, where choices are often made by the employer and are usually few and more expensive. Agents earn commission on the costs of plans.


Your small homeowners’ insurance claims can mean cancellation
Small claims on your policy means a money loser to insurers and they will cancel. Since the average big claim is 1 in 38 years, you may lose coverage if you file for amounts less than a full disaster. When you file a claim and it is denied, your claim is still counted against you. According to the TIAA-CREF Investment Options Survey, nearly 40% of Americans say they are not familiar with the investment options in their retirement plan. A target-date fund simplifies your decision. The mutual fund manager picks the right balance of stocks and bonds depending on how long you have until you need the money. At not-for-profit firms like TIAA and Vanguard, you pay low fees and thus earn more over time. You may end up with twice as much for retirement since you paid less for great diversification.

IRS won’t help finding which ID thieves stole from you—protecting ID thieves’ privacy?
You find out your tax return refund was already claimed by a thief. You ask the IRS for help in securing your ID. IRS says NO. IRS rules encourage its workers to keep a tight grip on the bad returns. Employees face felony charges for giving out private details -- including, possibly, those of the identity thieves -- to those who aren’t authorized. The old “privacy law” excuse to protect the criminals.

Regions bank owes you money for overcharging you
Today the Consumer Financial Protection Bureau (CFPB) took action against Regions Bank for charging overdraft fees to consumers who had not opted-in for overdraft coverage. The bank also charged overdraft and non-sufficient funds fees on its deposit advance product despite claims that it would not. Regions has already refunded hundreds of thousands of consumers approximately $49 million in fees, and the consent order requires the bank to fully refund all remaining consumers. The Bureau also fined the company $7.5 million for its illegal actions.
