Should you sign a vendor liability waiver?

Should you sign a vendor liability waiver?
Yes, as your favorite entertainment venue, a retail marketplace, restaurants and gyms open up for business, you will likely be asked to share the risk. Most businesses are asking their lawyer to draw up waivers. By signing a waiver, you are agreeing to the fact that the company wants you to assume their risk of operating. You might want to know if they have taken all precautions to keep you safe. Have they sprayed? Is staff tested on a regular basis? Are customers required to keep their distance? Do they limit the number of customers at a time? Do they require customer masks? If they don’t know or the terms of the waiver are vague, don’t sign. If they just put a sign on the door that you “enter at your own risk,” wait for another month or two, as these scientists point out.
Avoid the risk: Better safe than sorry.

Is a Roth IRA conversion right for you?
Fidelity Investments saw a 76% increase in the number of Roth IRA conversions in the first quarter of 2020. If your income has dropped due to job changes -– pushing you into a lower income tax bracket –- then it may be a good opportunity to convert to a Roth IRA. All your future gains will not be taxed. If your business lost money, the taxable loss can be used to offset other income on a personal tax return. IRA money is taxed when you convert because you did not pay tax on the contributions. You can control how much you convert so you can control how much you are taxed. You will need to do the math on your tax and probable income this year to decide on the amount to convert. If you do not have the extra cash to pay the tax next year, then converting just makes your taxes higher. However, the great benefit of a Roth is you can better manage your RMDs (required minimum distributions starting at age 72). Income in retirement can be controlled better since you have choices between taxable and non-taxable sources.

Where can you receive 2.4% yield for retirement income?
Quality bonds and steady dividend paying stocks. Isn’t that a better alternative to historically low rates from bonds and annuities? Consider a proven balanced fund like Vanguard’s Wellesley Income Fund. As of early June, the yield on 10-year Treasuries is only 0.66%, while Bloomberg Barclays Aggregate tracking index funds are yielding just over 1%. You cannot rely on bonds alone for the foreseeable future. Who knows where your stocks will end up in 2020? A low-cost balanced fund may offer you the best of both worlds in this environment. Over time, balanced funds provide the inflation hedge you will need long term. Average annual returns of 4-6% provide growth. Remember, your spending power is reduced by inflation every year—reduced 50% over 20 years. A 1st class stamp cost 32 cents in 2000. Now it’s 55 cents. Social Security may not keep up with your purchase items’ inflation. SS benefits will be cut by 2034.

Market rebound confounds all the fortune-tellers
Very few Wall Street gurus know that the stock market would bounce back so hard that their strategies would be crushed. The S&P 500 has rallied more than 40% from its March low amid central bank stimulus and better-than-expected economic data, defying warnings about elevated valuations and a collapse in profits. The Nasdaq 100 last week climbed to an all-time high, making a full recovery from this year’s bear-market decline. Timing the market is a loser’s game. At Friday’s close of 3,193.93, the S&P 500 exceeded all but four strategists’ year-end targets, based on a survey of 18 Wall Street prognosticators last month. So which strategy works? Certainly paying for bad advice only detracts from your long-term accumulation. Actually, over time, if you pay 2% for advice and trades and annual 12b-1 fees, you are giving your vendor HALF of your possible total returns.

What to do with your $1200

Suggestion list: What to do with your $1200 or $2400
Hold on to it for essentials as the future is unknown. If you must have cash to buy an essential down the line, you have it. Doctors, landlords, lenders, utilities can wait—they have reserves and access to federal lending programs we don’t have. Many states are making evictions and shutoffs illegal. If you have been laid off, explore your health care options. Trump says he will pay hospitals for C-19 care but what if you break a leg running your part-time business or fighting to get into the grocery store. Use some of your money to start/expand a hobby. People need something to do at home so offer your hobby/book/toys/etc over Amazon eBay, Craigslist, Facebook Marketplace, etc sales process. You may be allowed a tag sale in your front yard as long as you have 6 feet lines on ground. Better yet use Craig list. I sold an attic house fan that way. Never take anything on the internet for truth without ‘trust but verify’. I go to 3 other sources before I click. My garden center sent me an email offer with link to see details. I emailed them directly and they confirmed it was a scam/phishing from theft of their email list. Explore your situation. Ask your employer for help: vacation pay; forward sick time, student loan, etc. Ask your vendor for a couple of months wait in writing.
Gov resources to help deal with virus recession:

How the rich avoid paying taxes anywhere
It is easy—live where you want to but claim your legal residence—citizenship—in a country jurisdiction that does not tax money earned outside that country. In essence live in a tax haven—just officially. The rich maintain an intense schedule of travel using a virtual single-family office of professional management over their businesses. With accounting firms geographically dispersed, each is the cornerstone of their single-family management office. Their virtual family office coordinates experts and specialist serving the needs in specific geographic areas. This management scheme helps the wealthy be everywhere and nowhere at the same time. They are true global citizens—avoiding all local taxing and legal authorities. They even get C-19 screening tests immediately for free. Since money is no object, your family office will provide low taxes on your income from everywhere in the world and you just charge it to your personal credit card. When your yacht needs maintenance, the office in the country where it is docked takes over. Almost all your possessions and assets are owned by one of your companies so a wealth tax is as ineffective as the US income tax. You are not subject to jury duty or military service. Set up your own tax-free system here at home.

Does Trump receive a tax deduction since his name is on relief checks?
Will Trump’s accountants use the fact that his name appears on the check millions of voters receive use it as a marketing expense deduction for the campaign for president? In past campaigns, the use of his name has been a deductible expense. Why else would Trump insist to the Treasury Mnuchin that the IRS must delay checks by printing his name on the checks?  "During economic downturns in 2001 and 2008, President Bush included his name on letters sent in advance of recovery checks." The IRS refused to put Bush’s name on the checks. An observer noted that to avoid the potential for corruption or misuse of funds, a civil servant – not the president or someone appointed by the president – signs the checks. Trump wanted to actually sign as payer. Now he denies it and blames his staff. Treasury denies that coding software and reprinting the checks with Don’s name will NOT delay delivery despite previous reports. One Rep said: "So Trump is delaying the stimulus checks so his signature can be printed on each one. Him first. You second. Always." Trump makes $59 million on his name image.

Experts don’t know when businesses will restart
Every financial guru says they know but they are just guessing. This is not like any recession/depression before so we need to make plans to survive. Many are rescheduling their cruises in 2021 but that is more marketing (25% off). Wall Street’s ups and downs are just positive thinking by speculators. Politicians’ forecasts are biased. Some businesses will not be able to come back so the unemployed may have to shift jobs. More than 16.8 million Americans filed for new jobless claims. Some can’t even get the form to file. States’ cash is low. If there are over 10 million looking for work at the same time, it will take months to rehire/restart/restock for next year. Think of the lines when ads post 1,000 openings. Get refunds. Don’t waste that $1,200 paying bills. Doctors, landlords, lenders, utilities can wait—they have reserves and access to federal lending programs we don’t have. Many states are making evictions and shutoffs illegal. Perhaps a temp job will keep you motivated and fed for a few months. Prepare a budget to cover food necessities for 6 months so you don’t panic. We just don’t know and panic is all we can control now. During the ‘30s depression President Roosevelt helped us come together with a speech: “Only Thing We Have to Fear Is Fear Itself” Definitely worth reading today:
“Only a fool … can deny the dark realities of the moment.”

JPMorgan caught overcharging own employees again
JPMorgan sued for overcharging 401k employees: failed fiduciary: pensions will be cut. Paying the 2% fees over time causes total accumulations to be cut by over HALF. JPMorgan and 401k staff is robbing its employees of the pension they paid for. Like many other large and small companies, the owners seek to make the 401k plan a profit center. The fiduciary duty—making investment options that are best for the employee—is required by law. Almost every new hire is given poor investing advice by the HR department in charge of signing employees up for the owner’s plan. Most HR people are not financial planners so they tell most young and old employees to put all their money into so-called stable funds. HR recommends these funds so that the owner will not be sued when the employees account value goes down. However, for anyone under age 50, these are the worst investment choices since most employees have time to grow their accumulations at the market rate of 11% not 2%: stocks vs bonds. Morgan employees, like most 401k members will end up with $62,000 instead of $195,500. Only the enlightened employee will put all their contributions into the low-cost index fund if they can find it in their plan’s 56 page brochure.

Why file your taxes ASAP?
If you have refund, waiting gets you nothing. Could the IRS run out of money? Could gov computers make a mistake after April 15 because they did not get the email about extension to July 15? Is it possible there will be big delays since all the IRS and check printers are out of the office now in virus lockout? Just to avoid all the bad stuff, file now. Check your state for deadline. The federal and state filing can cost you nothing at https://apps.irs.gov/app/freeFile/. Another site has no cost or restrictions: https://www.creditkarma.com/tax. And remember you can usually reduce income and thus tax by making a deductible contribution to your IRA. File now for refund: 90 day interest-free extension if you owe. https://www.irs.gov/pub/irs-drop/n-20-18.pdf

Our new medical system: scrubs worn just for the ‘TV show’?

Our new medical system: scrubs worn just for the ‘TV show’?
You get to watch the Dr Skow ‘Show’ while he examines you from his (phone?) screen hundreds of miles away in the telemedicine center that provides remote emergency care for 179 hospitals across 30 states. Physicians for Avera eCare work out of computer screens (soon phones) instead of exam rooms. They wear scrubs ‘to look the part’ of traditional doctors on camera, even though they never directly see or touch you, their patients. If you can’t afford a real doctor, this is what you get for your $144 a month Medicare B payment. Rural America’s busiest emergency room is in fact a virtual ER located in a suburban industrial park. Instead of 25 doctors and staff, you now get 5 people in the room. None were doctors. None had significant experience performing emergency intubations. Downside: you still may receive a ‘surprise medical’ bill since another doctor may ‘consult’ by computer while you are in the ‘ER.’

Holiday gifts for your family

What is the best investment strategy for you?
Fidelity study: best investment strategy for accumulation over time was leaving your money alone to work for you by itself. The accounts that were forgotten or owned by dead people showed the best performance over time. Warren Buffett, one of the best investors, says the same thing—“We continue to make more money when snoring than when active." If you are not going to let your money work for you (impatience), it won’t grow as fast. This implies that Wall Street ‘professionals’ cost more than they are worth! Fees, trading, timing, special opportunities, etc are how we give up 50-60% of our overall potential accumulations by giving a ‘professional’ control of our money. In almost every period, we investors are better off using an index than an advisor: 11% vs 3.79%.

Your fund’s return--market index up 26.03%?
Low-cost investing in a diverse company fund like the Vanguard 500 can help you meet your goals. It also provides greater diversification, less volatility and more predictable earnings over time. We don’t need to worry about picking the right stocks or time to buy them. Most working people can accumulate $1 million for retirement with just one fund automatically invested from their paycheck. It is so simple: it’s like brushing your teeth—once you start it becomes a habit you do ‘automatically.’ This is Buffett’s strategy for investors: “A very low-cost index is going to beat a majority of the amateur-managed money or professionally-managed money.” He says you put your investment on autopilot and forget it. Chart: your total goes down sometimes but then it goes up 11% over time.

Is a ‘buffer’ annuity right for you?
Advisors love to have a new product to talk about so you should expect to hear this one buzz at you. Buffer annuities are invested in complicated structured products (such as options contracts). Structured products often provide the potential to offer higher returns, but also carry more significant risks than the traditional mutual fund investment because of the types of underlying investments (including emerging markets and REIT index options, which can be inherently more risky). Thus they do NOT provide full downside stops—only buffering your fall partly. Compare this situation to a variable annuity which provides less and an indexed annuity which provides more protection. Your ‘buffer’ is more complex and thus more misunderstood than a simple indexed annuity. ‘Buffers’ probably cost more because of the controlled risks involved in structured investments.

Social Security benefits
The 2020 cost of living increase will be eaten up with a higher Medicare B 2020 increase to $144. If medical costs are part of the ‘cost of living’ index, you would think the SS increase in 2020 would cover the medical increase. Since all the rules for SS benefits are complicated, who can argue? Most retirees agree that we should have started saving for these increases long ago. We should have dealt with inflationary increases by investing in securities that matched the long-term growth of successful businesses. We must own stock in a bunch of successful businesses and earn 11% over time.

Tax-FREE retirement just got bigger
IRS just increased the amount we can stash in our tax-deferred or tax-FREE accounts. We can put up to $26,000 into tax-advantaged accounts. Regular 401k and IRA reduce current taxes but cost more when we retire. Roth 401k and Roth IRA provide more tax-sheltered money when we take money out. We could invest $250 a month in a Roth 401k, receive our company match and spend $1,000,000 tax FREE later: Cost only $99,000.

Do income annuities really provide a “Worry-Free Retirement?”

Do income annuities really provide a “Worry-Free Retirement?”
Here is the claim: an income annuity provides insurance against outliving assets and not having sufficient spending power late in retirement. Income annuities are actuarial bonds. They provide longevity protection that is unavailable with traditional bonds. Retirees receive the bond yield curve plus mortality credits. Annuities increase risk capacity because the retiree's lifestyle is less vulnerable to a market downturn. Also, distributions from the stock portfolio can be lessened, reducing sequence risk and helping to preserve the investment portfolio. For those with a family history of long life, you will be assured of having some income for the rest of your life. You benefit from other annuitants’ short lives. However, this strategy is hardly ‘worry-free’ because 1. how much annuity to buy, 2. when to buy, 3. what about inflation: it reduces HALF the buying power of the benefit in 20 years, 4. how much for a later legacy, 5. there is no upside potential and no large asset in case of emergency needs, 6. annuities are non-refundable, 7. you forgo the total return of a stock portfolio—no dividends and no capital appreciation. Yes, annuities last for your lifetime but spending power and assets decline over time.

Even part-time self-employment can improve your situation
IRS just gave us the new rates in 2020. The Self-employed use many tax benefits not available to most mortals. For example, for tax year 1995, Trump claimed a $916 million LOSS that could have allowed him to legally avoid paying federal income taxes for up to 18 years. He and his accountants created the $1 billion paper loss by claiming business losses. Your business loss can offset your other family incomes like his did. Your business can even fund your retirement nest egg and still show a ‘loss’ on paper. You can deduct the cost of improvements (new tools, truck), meals for employees (family), your (QBI) rental real estate, routine maintenance, etc like corporations do. Most corporations pay no federal income tax. You can even claim part of your home and its property taxes. Also you can use these elections post-year end to achieve a desired tax result. You can pay your employees (family) as contractors and avoid some taxes and forms too. Some IRS changes hurt; some help.

Our Attorney General told to find dirt for 2020 election
Trump pushed the Australian prime minister during a recent telephone call to help Attorney General William P. Barr gather information for a Justice Department inquiry that Mr. Trump hopes will discredit the Mueller report. If Trump can Bribe Ukraine for investigation of Biden then we won’t be surprised if he encourages other countries to buy adverts in Facebook and other media to present Fake News for the 2020 election. Trump has Barr working Europe to dig dirt. Trump has McConnell stocking the courts with his disciples so he will win any lawsuit against him in the future. Trump has ‘moved’ to FL to assure safety in this GOP state. Even the Supremes may be asked to keep his tax returns from a legal investigation. This sounds like a right turn in American ‘democracy.’ There is hope in a new FoxNews poll that has voters choosing Hillary Clinton over Trump and she isn’t even running.

Trump tax cut has cost $ Trillions with no economic expansion
Last quarter economic growth of 1.9% is a far cry from the “4 percent, 5 percent and even 6 percent” growth rates that Trump once promised to deliver. Every time the GOP controls Washington, they promise the tax cuts that will be paid for by more growth. This is like the gambler who takes the family paycheck and promises that this week they will win the lottery. Thanks to both a tax cut that did not deliver growth and a trade war that backfired, most Wall Street economists believe manufacturing is already in recession. Even steel plants, which were supposed to be among the biggest beneficiaries of Trump’s tariff strategy, are shuttering. Since most of us got little out of Trump’s massive tax cuts, we must prepare for the coming tax increases. GOP used to care about deficits.

Is no-cost trading right for you?
Many brokerage firms are trying to get us to trade securities at no cost. But is this strategy working for you? A simple low-cost market index account is up over 24% so far. Even with no trading costs, can you really do better? How many market timers and special situations have beaten the market? Does your statement show the benchmark for comparison? Most don’t show your YTD total return number side-by-side with index. So how do you know how well your 1-2% fee strategy is doing over time? Most of us don’t take the advice of one of greatest investors, Warren Buffett: "The stock market is a device for transferring money from the IMPATIENT to the PATIENT."

Is your broker predicting bad returns in the future?
Morgan Stanley sees the market returns ‘tumbling’ in the future. Goldman sees no recession. Whose crystal ball do you believe? The analysts see the U.K. having the highest return potential for equities, followed by emerging-market shares. However, if UK is locked out of the EU by closing all borders, how can that happen? Is it even possible to predict the future? And if your broker can predict the future, what makes them think the UK is solid? Are you going to bet the ranch on your sales person who earns a living by thought persuasion? Predicting doom is easy since most of us are optimists and aren’t going to sell all for CDs. Is it more likely that a broad exposure to most of the markets will provide your best chance of positive 9% returns? Are you going to keep your money in 2% CDs for 10 years? Really? How will you know when to buy again?

What does one of the greatest investors recommend?
Buffett bet $1 million that his recommended investment—just one simple fund—would beat a Wall Street guru with 5 different strategies. Active money management does not help you more than it helps its manager. Buffett says: “A very low-cost index is going to beat a majority of the amateur-managed money or professionally-managed money.” So why don’t more people take his advice: everyone thinks they are smarter than the market and can find the needle in the haystack. Over and over research shows you can’t. Most investors earn just 3.79% not the market index return of 11% over time.

Looking for a trustworthy broker?
All the advice articles, including my own, suggest you do a search of complaints at the self-regulation organization called FINRA. However, its BrokerCheck does not have all the bad news and troubled past of many brokers. Those who have problems move to another firm and state and have their records expunged. Take a recent example: First Standard Financial was a registered investment advisor recently caught for unauthorized, unsuitable, excessive trading. It was notorious for hiring bad brokers who joined with questionable past activity and many customer complaints. The owner of First Standard is Carmine Anthony Berardi. His securities record has no listings for his 11 years in the business: https://brokercheck.finra.org/individual/summary/4879362#timelineSection. First Standard worked out of offices in New Jersey even though Carmine acts as chief compliance officer from Garden City NY. New Jersey shut down First Standard and froze its assets after finding its agents raked in more than $28.7 million through “pervasive unauthorized, unsuitable and excessive trading.” Potential customers would have no idea they would suffer under the brokers from this firm. You would have had to do exhaustive due diligence to find the true record of brokers like Andre Pierre Davis and William Christian Gennity who worked at First Standard. https://stockbrokerfraud.com/tag/first-standard-financial-company-llc/ Note that this malfeasance has gone on a long time and only now has First Standard in NJ been stopped. Customers will have to wait a long time if ever for their money back. You are better off with Warren Buffett as your advisor.
